AUDIO: THIS YEAR'S ICE CREAM TRUCK LAWSUIT STORY

The Mister Softee ice cream truck company is suing the 3-DDD company for infringing on their ice cream truck jingle. Mister Softee Inc. has owned the copyright to the tune since 1960. But 3-DDD was caught using the jingle on its truck in Brooklyn, New York. A video shows the 3-DDD truck playing the jingle “as it attracts customers.” The driver of the 3-DDD truck, Dimitrios Konstantakakos, insists that his business is “cutthroat” and that there is often room for only one ice cream truck in a prime location. Mister Softee’s franchisees pay an annual fee to use the trademarks, including the jingle. Last year, Mister Softee sued the prior owner of Konstantakakos’ truck for using the mark “Master” Softee. The court ruled in favor of Mister Softee, though Mister Softee is still trying to collect that judgment of $97,000.
